T&C's #YesToTommy
By responding #YestoTommy you agree to the following:
1. You grant to Tommy Hilfiger Europe B.V., its affiliates, assigns, licensees and customers(“Hilfiger”) a royalty free, perpetual, worldwide license to use your Instagram comment(s) and/or your Instagram photograph(s) that you have tagged with the hashtag #tommyhilfiger and/or in relation to which you have responded #YestoTommy (together the “Pictures”),on any offline and online media including but not limited to Internet (such as social media, blogs, Tommy Hilfiger related websites), press release, editorial print and online, newsletters, in-store/point of sale materials. Hilfiger may use, reproduce, distribute, combine with other materials, alter and/or edit, copy, publish, save, store, archive your Pictures in any manner in its sole discretion, with no obligation to you whatsoever.
2. You hereby represent and warrant that (i) you own all rights in and to your Pictures, including copyright, (ii) you have permission from any person(s) appearing in your Pictures to grant the rights herein, (iii) you have reached the legal age of majority in your jurisdiction of residence, and (iv) Hilfiger’s use of your Instagram Pictures will not infringe any third party’s right or any law.
3. You hereby release, discharge and agree to hold Hilfiger and any person acting on behalf of Hilfiger harmless from all actions, claims, damages, liabilities, costs and expenses arising out of the use by Hilfiger of the Pictures.
4. You hereby release and discharge Hilfiger from all and any obligation to pay you for any use of your Pictures and any of the intellectual property rights contained therein in connection with the uses described above.
5. To the extent European Data Protection law is applicable, you hereby consent and accept that your personal data as included in the Pictures (the “Data”) will be processed by and on behalf of Tommy Hilfiger Europe B.V. and will be transferred outside the European Economic Area, for the purposes stated in these Terms of Use. By providing your consent you acknowledge that you have read and agree with the contents of the Privacy Notice.

7. If you delete your #YestoTommy approval post, or your Pictures from Instagram, your agreement to these Terms and Conditions is still applicable.
8. A translation of these Terms & Conditions can be sent to you via email if you send an email to digmar@pvh.com, requesting a translation.
9. Your agreement to these Terms and Conditions can be revoked and your rights under clause 5. Above can be exercised by sending an email to digmar@pvh.com, explicitly stating your willingness to revoke your consent.
