이미지 사용 및 개인정보 처리 동의서

저희는 귀하의 이미지가 마음에 들며, 다른 사람들이 귀하의 이미지를 저희의 웹사이트, 소셜 미디어 채널, 판매회사 웹사이트에서 볼 수 있으면 유익할 것이라고 생각합니다. 귀하가 저희에게 귀하의 이미지 공개를 허락하실지 고려하실 수 있도록 저희가 귀하의 이미지를 어떻게 활용할지에 대해 정확하게 알려드리겠습니다.

귀하는 저희의 인스타그램(Instagram) 게시물에 #yesUNIQLO로 사용을 허락하는 것으로 귀하가 해당 이미지의 소유권자이며 다른 어떤 사람 또는 단체도 이에 대해 권리를 주장할 수 없음을 보증하게 됩니다. 귀하는 유니클로(UNIQLO CO. LTD.) 및 계열회사에게 이미지를 형식(비디오, 인터넷 게시, 복제, 공개, 이메일, 출판 또는 배포를 의미하나 이에 한정하지 않습니다)에 구애받지 않고 복제할 수 있는 비독점적이고 철회 불가능한 상업적인 권리를 허락합니다. 또한 저희는 자체 서비스 또는 제3자가 제공하는 서비스를 통해 현재 알려져 있거나 이후에 개발되는 모든 매체를 이용하여 아무런 제약이나 제한 없이 전 세계에 귀하의 이미지를 복제할 수 있습니다. 귀하는 이미지가 (단독으로 또는 스케치, 만화, 자막, 영상, 미술품, 직물 또는 기타 사진과 함께) 유니클로 및 계열회사에 의해 사용될 수 있으며, 유니클로 및 계열회사가 귀하의 이미지를 수정하고 2차적 저작물을 만들 수 있다는 것에 동의합니다. 마지막으로 귀하는 저희가 귀하의 이미지를 게시 할 때 귀하의 인스타그램 계정이 연동되어 공개될 수 있음에 동의합니다.

유니클로는 귀하에게 사진에 대한 크레딧을 부여하고 귀하의 인스타그램 계정에 사진이 게시된 링크를 제공하기 위하여 통상적으로 합당한 노력을 취할 것입니다. 다만 해당 크레딧은 의무적인 사항이 아님을 알려드리며, 귀하께서는 이미지 사용의 허락이 크레딧 제공을 조건으로 하지 않는다는 것에 동의합니다.

귀하는 이미지가 포함된 작업 결과물이나 이와 함께 사용되는 광고 문구 또는 작업 결과물의 사용에 관하여 어떠한 검사 또는 승인 등의 권리를 포기합니다. 또한 귀하는 이미지 또는 저희의 결과물과 관련하여 어떠한 로열티의 청구를 할 수 없습니다.

단, 귀하의 이미지가 개인정보를 포함하고 있다면 언제든지 동의를 철회할 수 있고 결과물의 삭제도 요청하실 수 있습니다. 저희는 귀하의 동의 철회 시까지 개인정보를 보유합니다. 귀하의 개인정보는 귀하가 거주하시는 국가 이외의 지역에 위치하는 서버, 계열회사 또는 제3의 수탁자에게 이전될 수 있으며 이전 받은 자는 유니클로를 대리하여 귀하의 개인정보를 처리할 수 있습니다. 귀하가 유니클로의 이미지 사용에 동의하면, 유니클로가 개인정보를 수집, 사용, 공개, 이전 등 처리하는 것에 동의하는 것으로 간주합니다. 단, 이 경우 유니클로는 본 동의서와 유니클로의 개인정보처리방침, 관련 개인정보 보호 법령을 준수합니다.

마지막으로, 귀하는 본 동의서에 포함된 규정 또는 규정의 일부가 관련 법령에 따라 무효인 것으로 결정되는 경우, 해당 규정은 본 동의서에서 제외된다는 것과 본 동의서의 나머지 부분은 완전한 효력을 유지한다는 것에 동의합니다. 본 동의서는 일본법의 적용을 받습니다..

귀하가 본 동의서에 동의하지 않으시더라도 저희는 충분히 이해하며, 어떠한 추가 조치도 하실 필요가 없습니다. 저희는 유니클로와 귀하의 관계를 중요하게 생각하며 귀하의 계정에서 유니클로와 관련된 사진들을 더 볼 수 있기를 기대하고 있습니다.

IMAGE USE AND PERSONAL INFORMATION PROCESSING AGREEMENT

We love your image and know others will benefit from seeing it on our website, social media channels, and retailers' websites. As you consider allowing us to publish your image, we want to make sure you know exactly how we intend to use it.

By replying to our Instagram post with #yesUNIQLO and providing your permission, you represent and warrant that you own the image and there are no other entities with ownership claims over it. You grant UNIQLO CO. LTD. and its affiliates a non-exclusive and non-revocable commercial right to reproduce the image in any form (including, but not limited to, video, internet posting, reproduction, display, email, publication, and distribution), either through our own services or services provided by third parties, throughout the world in any medium now known or later developed and without restriction or limitation. You agree that your image may be used by UNIQLO CO. LTD. and its affiliates (either alone or in conjunction with sketches, cartoons, captions, films, art work, textural matter or other photographs) and that UNIQLO CO., LTD. and its affiliates may alter your image and make derivative works. You agree that your Instagram account may be linked when we post your images.

While UNIQLO CO. LTD. will make commercially reasonable efforts to give you credit for your photo and provide a link back to your Instagram account, you agree that such credit is not mandatory and your permission for us to use your image is not contingent upon such credit being given.

You waive any right to inspect and/or approve the finished work incorporating the image or the advertising copy that may be used in connection therewith or the use of which said finished work may be applied. Further, you waive any claims to royalties with regards to your image or our finished work.

In the event that your image contains personal information, you retain the right to revoke approval and request removal of the finished work at any time. We hold your personal information till your withdrawal. Your personal information may be transferred to servers located outside the country in which you live or to affiliates or other trusted third parties based in other countries so that they may process personal information on UNIQLO CO., LTD.'s behalf. By agreeing to UNIQLO CO. LTD.'s use of your image, you agree to such collection, use, disclosure, transfer and processing of your information in accordance with the terms of this Image Use Agreement, UNIQLO CO LTD.'s privacy policy and applicable data protection laws and regulations."

Last, you agree that if any provision, or any portion of any provision, contained herein is determined to be invalid under any statute or rule of law, then it shall, to that extent alone, be deemed omitted, and the remainder of this Image Use Agreement shall remain in full force and effect. This Image Use Agreement shall be governed by the laws of Japan. If you don't agree to these terms, we completely understand and no further action is required. We are thrilled to see UNIQLO CO. LTD. as a part of your page and look forward to seeing any new photos you post as well.
